Terms and Conditions
These Terms and Conditions ("Terms") govern the sale of products by Miss T Chocolates ("we," "us," or "our") to you ("Customer" or "you"). By placing an order with Miss T Chocolates, you agree to be bound by these Terms.
1. Order Processing, Payment, and Delivery/Pickup
1.1. Order Confirmation: All orders are subject to availability and confirmation by Miss T Chocolates. We will confirm your order details, including the total cost and estimated delivery or pickup date, upon successful placement of your order.
1.2. Payment:
- Standard Orders: Full payment for standard orders must be received no later than 7 calendar days prior to your scheduled pickup or delivery date.
- Large Orders & Deposits: For orders exceeding a value of $300 or for custom/event orders, a non-refundable deposit of 50% of the total order value is required at the time of order confirmation. The remaining balance must be paid in full no later than 7 calendar days prior to the scheduled pickup or delivery date. Your order will not be started until the deposit is received.
1.3. Cancellations and Refunds:
- Standard Orders: For a full refund, cancellations of standard orders must be made in writing and received by Miss T Chocolates no less than 7 calendar days prior to the scheduled pickup or delivery date. Cancellations made less than 7 calendar days but more than 3 calendar days before the scheduled date will be eligible for a 50% refund. No refunds will be issued for cancellations made less than 3 calendar days before the scheduled date.
- Large Orders & Custom Orders: The deposit paid for large or custom orders is non-refundable. For the remaining balance, the same cancellation policy as standard orders applies (full refund if cancelled 7+ days prior, 50% refund if cancelled 3-6 days prior, no refund if cancelled less than 3 days prior).
1.4. Pickup/Delivery:
- Pickup: You are responsible for picking up your order at the agreed-upon date and time from our designated location. If you are unable to pick up your order at the scheduled time, please contact us as soon as possible to arrange an alternative. Unclaimed orders may be forfeited without a refund. Once bonbons have been picked up, Miss T Chocolates is no longer responsible for their condition or any damage incurred.
- Delivery: If delivery is arranged, we will deliver your order to the address provided. It is your responsibility to ensure the accuracy of the delivery address and that someone is available to receive the order. Miss T Chocolates is not responsible for delays, damage, or issues arising from incorrect delivery information, or for the condition of the bonbons once they have been delivered to the specified address. All sales are final, and no refunds will be issued after product delivery.
1.5. Our Right to Cancel/Unforeseen Circumstances:
- In the rare event that Miss T Chocolates needs to cancel an order or is unable to fulfill it due to unforeseen circumstances (e.g., equipment failure, illness, natural disaster, supply chain disruption, or other force majeure events), we will notify you as soon as reasonably possible.
- In such cases, we will offer you a full refund of any payments made, including any deposits, for the unfulfilled order. We will not be liable for any additional compensation or damages beyond the refund of the amount paid for the order.
2. Product Information and Care
2.1. Best Before Date: Our bonbons are crafted for optimal freshness and are best enjoyed within 10 days of purchase.
2.2. Storage: To maintain their quality, please store your bonbons in a cool, dry place, away from direct sunlight and heat sources. An ideal temperature is below 18°C (64°F). Refrigeration is generally not recommended as it can affect texture and flavour, unless specified for certain products.
2.3. Handmade Variations: Miss T Chocolates are handmade with care, and as such, there may be minor variations in appearance, size, and color between individual bonbons and batches. All illustrations and descriptions displayed on Miss T Chocolates' social media pages, website, distributed by email, or in any other way are for guidance purposes only and may not perfectly reflect the final product.
3. Allergen and Ingredient Information
3.1. Allergen Disclaimer: Our products are produced in a facility that handles various ingredients. While we take precautions, our products may contain or come into contact with common allergens including, but not limited to: dairy, nuts (tree nuts and peanuts), gluten, wheat, soy, gelatin, eggs, and alcohol.
3.2. Ingredient Inquiries: We strongly advise you to inquire about specific product ingredients and potential allergens before placing your order, especially if you or your guests have allergies or dietary restrictions.
3.3. Customer Responsibility: By purchasing our products, you acknowledge and agree to notify your guests, recipients, or anyone who will consume the products of these potential allergen risks. You agree to hold Miss T Chocolates harmless from any allergic reactions or health issues that may arise from the consumption of our products.
4. Limitation of Liability
4.1. Miss T Chocolates will not be liable for any indirect, incidental, punitive, special, or consequential damages arising from the use of our products or inability to use our products, even if advised of the possibility of such damages. Our total liability for any claim arising out of these Terms or the sale of our products shall not exceed the amount paid by you for the specific product giving rise to the claim.
5. Governing Law
5.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Ontario, Canada without regard to its conflict of law principles.
6. Changes to Terms and Conditions
6.1. Miss T Chocolates reserves the right to update or modify these Terms and Conditions at any time without prior notice. The most current version will always be posted on our website or available upon request. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
